OVERVIEW
This website and online store are operated by STEPHEN NOEL & ALISON ELIZABETH HALL, a partnership trading as FAREWELLHILL Australian Cattle Dogs. Throughout these Terms of Service, the terms “FAREWELLHILL”, “we”, “us” and “our” refer to STEPHEN NOEL & ALISON ELIZABETH HALL trading as FAREWELLHILL Australian Cattle Dogs.
FAREWELLHILL offers this website, including its information, content, features, tools, products and services, to you subject to these Terms of Service and the policies referenced within them.
By visiting our website, creating an account or purchasing from our online store, you agree to these Terms of Service. Please read them carefully before using the website or placing an order.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
- ELIGIBILITY AND ACCOUNTS
You must be legally capable of entering into a binding agreement to place an order through our online store. If you are under 18, you must have permission from a parent or legal guardian.
You agree to provide accurate, complete and current account, contact, billing and delivery information.
You are responsible for maintaining the security of your account and login details and for activity conducted through your account. Please contact us promptly if you believe your account has been accessed without permission.
Customer accounts are optional unless otherwise stated at checkout.
- PRODUCTS AND PRODUCT IMAGES
We make every reasonable effort to describe and display our products accurately.
Product images and mock-ups are provided for illustrative purposes. Colours and product appearance may vary slightly due to screen settings, device displays, photography, lighting, manufacturing processes and the materials used. The size and placement of printed, transferred, embroidered or woven artwork may also vary slightly according to the product, size and decoration method.
These reasonable variations do not limit your rights where a product is faulty, materially different from its description or otherwise fails to meet a consumer guarantee under Australian Consumer Law.
Product descriptions, colours, sizes, availability and specifications may be updated when necessary. We may discontinue a product or limit available quantities.
- PREORDERS
Many FAREWELLHILL merchandise products may be offered by preorder.
A preorder product is not available for immediate dispatch. It may be ordered, produced or decorated after customer orders have been collected.
Production and dispatch timeframes are estimates and may be affected by supplier availability, production schedules and other circumstances. We will provide updates where appropriate and send tracking details after an order has been dispatched.
Please review your product, colour, size, decoration and delivery selections carefully before placing a preorder.
Requests to change or cancel a preorder should be made as soon as possible by emailing orders@farewellhillcattledogs.com.au. We may be unable to approve a change or cancellation after production or processing has commenced.
Nothing in this section limits your rights under Australian Consumer Law.
- ORDERS
Placing an order constitutes an offer to purchase the selected products under these Terms.
We may decline or cancel an order where reasonably necessary, including if:
• a product is unavailable
• there is an obvious pricing or product-information error
• payment cannot be processed or verified
• fraud or unauthorised activity is suspected
• delivery cannot be made to the supplied address
• an order breaches these Terms or applicable law.
If we cancel an order after payment has been received, we will provide a refund to the original payment method unless another arrangement is agreed with you.
An automated acknowledgement or confirmation does not prevent us from correcting an obvious error or cancelling an order for one of the reasons above.
Products purchased through the store are intended for personal or household use unless otherwise agreed with us. They must not be commercially resold without prior written permission.
- PRICES, GST AND PAYMENT
Unless stated otherwise, all prices are displayed in Australian dollars and include GST where applicable.
Shipping charges and any other applicable costs will be displayed at checkout before payment is completed.
Prices, products and promotions may change without notice. Changes will not affect an order already accepted, except where there is an obvious error that we promptly bring to your attention.
You confirm that you are authorised to use the payment method supplied with your order and that the payment and billing information provided is accurate.
Payment is processed through the payment methods displayed at checkout. Additional terms from the selected payment provider may apply.
- SHIPPING AND DELIVERY
Shipping options, charges, estimated carrier timeframes, tracking and delivery conditions are explained in our Shipping Policy, available through the website footer.
Delivery estimates commence after production, processing and dispatch. Preorder production time is separate from carrier delivery time.
Customers are responsible for supplying a complete and accurate delivery address. Please contact us promptly if an address needs to be corrected.
We will take reasonable steps to dispatch and deliver orders in accordance with the information provided. Delivery may be affected by carrier delays, severe weather, public holidays, remote locations and other circumstances outside our reasonable control.
Nothing in this section limits any rights or remedies available under Australian Consumer Law.
- RETURNS, EXCHANGES AND REFUNDS
Returns, exchanges, preorder cancellations and refunds are governed by our Return and Refund Policy, available through the website footer.
Our voluntary change-of-mind policy applies in addition to, and does not replace, rights available under Australian Consumer Law.
- INTELLECTUAL PROPERTY
Unless otherwise stated, the content of this website—including the FAREWELLHILL name and branding, logos, text, photographs, artwork, graphics, videos, page design and other materials—is owned by or licensed to FAREWELLHILL and is protected by applicable intellectual-property laws.
You may access and use the website for personal, non-commercial purposes.
You must not copy, reproduce, modify, distribute, publish, sell, commercially exploit or create derivative works from our website content without prior written permission, except where permitted by law.
Third-party names, logos and trademarks displayed on the website remain the property of their respective owners.

Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer products and services to you.
Sales made through this store are made directly between you and FAREWELLHILL. Shopify is not the seller of FAREWELLHILL products and is not responsible for fulfilling orders, handling product enquiries or providing remedies relating to those products.
Shopify may process information and provide services necessary to operate the online store, as further explained in the applicable privacy policies.
- PRIVACY
Personal information collected through this website is managed in accordance with our Privacy Policy, available through the website footer.
Because our store is hosted by Shopify, personal information may also be collected and processed by Shopify and relevant service providers to operate and improve the online store, process transactions and provide requested services.
- REVIEWS, PHOTOGRAPHS AND FEEDBACK
If you voluntarily submit a review, photograph, testimonial, suggestion or other content to FAREWELLHILL, you confirm that:
• the content is yours or you have permission to submit it
• it is accurate and not misleading
• it does not infringe another person’s rights
• it is not unlawful, abusive, defamatory or harmful.
You grant FAREWELLHILL a non-exclusive, worldwide, royalty-free licence to reproduce, publish and display the submitted content for reasonable business and promotional purposes.
We may moderate or remove content that breaches these Terms or applicable law. We are not obliged to publish every submission.

To the extent permitted by law, FAREWELLHILL is not liable for loss caused by:
• misuse of a product or failure to follow supplied care instructions

• inaccurate information supplied by the customer

• an event outside our reasonable control where we have taken reasonable steps to minimise its effects.
This section does not limit liability for faulty goods, misleading conduct, negligence or any other liability that cannot lawfully be excluded.
- TERMINATION
You may stop using the website at any time.

Any outstanding payment obligations and provisions intended to continue after termination remain effective.
